1. Legal Entity

These Terms of Service govern your use of the website and services provided by URINBAYEV KUDAIBERGEN, an auto-entrepreneur (micro-entreprise) registered in France, operating under the trade name BuildFast.Studio.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Services Provided

BuildFast.Studio provides AI workflow automation services, including but not limited to:

• Custom AI pipeline development for document processing
• Workflow automation implementation
• Data extraction and analysis systems
• Integration with existing business systems
• Technical consulting and advisory services

Specific project scope, deliverables, timelines, and pricing are defined in individual project proposals and contracts.

3. Project Engagement Process

Our engagement process follows these steps:

1. Discovery Call: Initial consultation to understand your requirements (free, no obligation)
2. Proposal: Detailed project proposal with scope, timeline, and pricing
3. Agreement: Formal project contract upon acceptance of proposal
4. Development: Implementation according to agreed milestones
5. Delivery & Handoff: Final delivery, documentation, and training
6. Post-Launch Support: 30 days of included support

4. Pricing and Payment Terms

• Currency: All prices are quoted in Euros (€) unless otherwise specified
• Payment Schedule: Typically split into milestones (e.g., 40% upfront, 30% mid-project, 30% upon completion)
• Payment Methods: Bank transfer, PayPal, or other methods as agreed
• Late Payments: Late payments may incur interest charges and suspend project work
• Invoicing: French-compliant invoices will be issued for all payments

Specific payment terms will be detailed in your project contract.

5. Intellectual Property

Client IP: Upon full payment, you own the custom code and systems developed specifically for your project, excluding any pre-existing libraries, frameworks, or reusable components.

Reusable Components: We retain rights to generalized tools, libraries, and methodologies developed during the project that can be reused for other clients.

Third-Party Software: Any third-party libraries or APIs used are subject to their respective licenses.

6. Confidentiality

We treat all client data and project information as confidential. We will not disclose your proprietary information to third parties without your consent, except as required by law.

With your permission, we may create anonymized case studies showcasing project outcomes without revealing sensitive business information.

7. Project Changes and Scope

Projects are scoped with clear milestones and deliverables:

• Minor Adjustments: Small changes within the agreed scope are included
• Major Changes: Significant scope changes will be discussed and may result in adjusted timeline and pricing
• Change Requests: Must be documented and approved by both parties before proceeding

8. Warranties and Disclaimers

We warrant that:

• Services will be performed with professional care and expertise
• Deliverables will substantially conform to agreed specifications
• We have the right to provide the services

Disclaimer: Services are provided "as is" for custom development. We do not guarantee specific business outcomes, ROI, or that AI systems will be 100% accurate in all cases. Systems include human-in-the-loop review for quality control.

9. Limitation of Liability

To the maximum extent permitted by French law:

• Our total liability is limited to the total fees paid for the specific project
• We are not liable for indirect, consequential, or incidental damages
• We are not liable for losses resulting from third-party services or force majeure
• You are responsible for maintaining backups of your data

10. Data Protection and Privacy

We comply with GDPR and French data protection laws. See our Privacy Policy for details on how we collect, use, and protect your information.

For projects involving sensitive or regulated data, we can implement on-premise processing or private cloud solutions as required.

11. Termination

Client Termination: You may terminate a project with written notice. You are responsible for payment for work completed up to the termination date.

Provider Termination: We may terminate if you breach these terms, fail to make payments, or if continuing the project becomes impractical.

Upon termination, you will receive all completed work and documentation. Partial refunds may be issued for unused prepaid work.

12. Support and Maintenance

Included Support: 30 days of post-launch support for bug fixes and clarifications

Extended Support: Optional ongoing support and maintenance packages available separately

You own the delivered system and can maintain it in-house. We provide documentation and training for self-maintenance.

13. Governing Law and Disputes

These Terms are governed by French law. As an auto-entrepreneur registered in France, all business operations are subject to French commercial regulations.

Dispute Resolution: We encourage good faith negotiations to resolve disputes. If resolution cannot be reached, disputes will be subject to the jurisdiction of French courts.

For cross-border projects, specific dispute resolution terms may be included in project contracts.

14. Force Majeure

Neither party is liable for delays or failures due to circumstances beyond reasonable control, including natural disasters, war, pandemics, government actions, or third-party service outages.

15. Entire Agreement

These Terms, together with individual project contracts and proposals, constitute the entire agreement between you and BuildFast.Studio (URINBAYEV KUDAIBERGEN).

16. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of services after changes constitutes acceptance.
